Six Years In, and Still No Finish Line: The Road Ahead for Ex-Ante Regulation in Digital Markets
On 11 August 2025, the Standing Committee on Finance presented its report on ‘Evolving Role of Competition Commission of India in the Economy, particularly in the Digital Landscape’ (Report) before the Parliament. The Report echoes the recommendations of the Big Tech Report and the CDCL Report for designing an ex-ante regulatory framework for regulating digital markets.
In this alert, we briefly set out the key recommendations of the Report which include: (a) proactive protection of digital markets through an ex-ante law, but in a nuanced, phased and evidence-based manner; (b) certain amendments to the proposed Digital Competition Bill to manage impact on emerging Indian technology companies and MSMEs; and (c) institutional and capacity-building initiatives to improve the functioning of the Competition Commission of India.
