C&M secured a significant judgment for Asianet Digital from the Kerala High Court

C&M secured a significant win for Asianet Digital from the Kerala High Court that reaffirms the jurisdiction of the Competition Commission of India over competition issues in regulated sectors.


The Court emphasised that the Commission and the sectoral regulator occupied distinct fields, without ousting each other’s jurisdictions. Any question on which regulator should assume jurisdiction can be addressed by the Commission itself before deciding any substantive issues. The Court also dismissed challenges to the adequacy of the Order directing investigation.


The judgment develops the current Supreme Court jurisprudence on regulatory overlaps by giving the Commission the power to determine sequencing and limiting the role of writ courts while assessing initiation orders.
